Service Agreement / Terms and Conditions

 

Welcome to https://www.coastalbins.com, a website and a set of services owned and 

Coastal Bins shall furnish equipment and services, to collect and dispose of and/or recycle all of Customer’s waste materials. Customer represents and warrants that the materials to be collected under this Agreement shall be only “Waste Materials” as defined herein. For purposes of the Agreement, “Waste Materials” means all non-hazardous solid waste and recyclable materials generated by Customer or at Customer’s Service Address. Waste Materials specifically excludes, and Customer agrees not to deposit or permit the deposit for collection of, aerosol cans, ballasts with PCB's, devices containing mercury, fluorescent bulbs, telephone poles, railroad ties, other treated wood, clothing of any kind and household garbage (food garbage). Industrial process wastes, asbestos containing material, petroleum contaminated soils, treated/de-characterizes wastes, any waste tires, radioactive, volatile, corrosive, flammable, explosive, biomedical, infectious, biohazards, regulated medical or hazardous waste, toxic substance or material, as defined by, characterized or listed under applicable federal, state, or local laws or regulations, or Special Waste not approved in writing by, Company

Title to and liability for “Excluded Material” shall remain with Customer at all times. Customer is responsible for any and all fine, levies, taxes or fees associated with the disposal of unauthorized waste. Note pressure treated lumber is considered special waste and will significantly increase cost please call for price and written approval before placing in dumpster)

 

Term of agreement

The initial term of this Agreement is immediately effective from the purchase of our services by the customer. Any customer has the chance to consult and verify our pricing list for the provided services directly on the Website, at https://www.coastalbins.com/pricing, while the bin sizes are available at https://www.coastalbins.com/bin-sizes

 

 

 

Equipment & Access

All equipment furnished by Coastal Bins shall remain the property of Company; however, Customer shall have care, custody and control of the equipment and shall bear responsibility and liability for all loss or damage to the equipment and for its contents while at Customer’s location. Customer shall not overload, move or alter the equipment and shall use the equipment only for its intended purpose. At the termination of this Agreement, customer shall return the equipment to Company in the condition in which was provided, normal wear and tear excepted. Customer shall provide unobstructed access to the equipment on the scheduled collection day. Customer shall pay, if charged by company, any additional fee for any service modifications caused by or resulting from Customer’s failure to provide access.

 

Waiver of Liability

Coastal Bins is NOT responsible for any damage to "Customer's" property, including walkways, curbing, pavement, driveways, pavers, irrigation, wells, septic or underground utilities resulting from the company's provision of services.  "Customer" warrants that the right of way is sufficient to bear the weight and physical dimensions of the Coastal Bins equipment and vehicles.  "Customer" understands that lawn damage may occur during a construction/clean-up project.  No repair is offered or provided.

 

Overfilled Dumpsters

"Customer" agrees not to over-fill the dumpster beyond the "Max Load" witch is the top rail of the dumpster. (note concrete, dirt, or other heavy materials stop when half full)  An over-filled dumpster may allow debris to fall out and damage other cars and trucks and it is against the law to transport an over-filled dumpster. Coastal Bins reserves the right to refuse to pick up an over-filled dumpster. If over-filled, the "Customer" will be responsible for removing over-filled debris down to the "Max Load" line.  An additional charge to the "Customer" may be charged if this event will occur.

 

Blocked Dumpster

If Coastal Bins attempts to deliver or pick up a dumpster and the dumpster is blocked or a gate is locked or prevented in any way from delivering or picking up a dumpster the "Customer" will be charged with an additional penalty fee.

 

Indemnity

The Company agrees to indemnify, defend and hold Customer harmless from and against any and all liability which Customer may be responsible for or pay out as a result of bodily injuries (including death), property damage, or any violation or alleged violation of law, to the extent caused by any negligent act, negligent omission or willful misconduct of the Company or its employees, which occurs (1) during the collection or transportation of Customer’s Waste Materials, or (2) as a result of the disposal of Customer’s Waste Materials, after the date of this Agreement, in a facility, provided that the Company’s indemnification obligations will not apply to occurrences involving “Excluded Materials”. Customer agrees to indemnify, defend and hold the Company harmless from and against any and all liability which the Company may be responsible for or pay out as a result of bodily injuries (including death), property damage, or any violation or alleged violation of law to the extent caused by Customer’s breach of this Agreement or by any negligent act, negligent omission or willful misconduct of the Customer or its employees, agents or contractors in the performance of this Agreement or Customer’s use, operation or possession of any equipment furnished by the Company. Neither party shall be liable to the other for consequential, incidental or punitive damages arising out of the performance of this Agreement.

 

Charges

Customer shall pay for the services and/or equipment furnished by Company in accordance with the charges on this agreement side, as adjusted hereunder, upon receipt of equipment (unless prior arrangements have been agreed to by both parties). In any case, we reserve the right to modify the prices and the content of our services at any time, without any written or verbal notice.

 

Extra Charges 

Extra charges may apply to overloaded containers, additional trip charges, damaged equipment, disposal fees associated with improper items placed in container, household garbage or other prohibited materials that are outlined in this agreement. Additionally, extra charges will apply in case of “Excluded Material” disposal into the bins.Due and payable upon receipt. 2% interest on balance over 30 days ( 26.8% per annum ) 

 

Delivery and Pick Up of Containers

We make every effort possible to ensure timely and reliable delivery and pick up of containers. However, due to circumstances beyond our control, we cannot and do not guarantee delivery times or dates. Inclement weather, hazardous roads and driving conditions, traffic delays, motor vehicle accidents, delays at landfills, equipment failure, etc., happen occasionally and we cannot be responsible for these delays. We do not guaranteed next day service for deliveries or pickups. It may take us up to 72 hours to service your dumpster depending on all of the above circumstances and how busy our schedule is.  

 

Payment methods

We currently accept major credit card providers and PayPal as valid methods of payment. In any case, the customer - using a determined credit card or a PayPal account - expressly demonstrates to be the legal owner of the payment method or to have the full right to properly use it.

 

Engaging In Our Service(s) Constitutes A Legally Binding Service Agreement In the event that it shall become necessary to employ an attorney to collect any amount due under this terms and condition, then customer will be liable for attorney’s fees and cost incurred in such collection.

By using or engaging in our service(s), you hereby acknowledge and agree to the terms and conditions above. Coastal Bins takes all dumpster orders over the phone or via our website. Therefore, we are unable to obtain a written and/or signed service agreement. For all intents and purposes regarding financial and/or legal issues, the terms and conditions found here shall constitute a legally binding service agreement and shall have the same force and effect as a signed service agreement.

Jurisdiction 
We act under the purposes of the Canadian set of laws. In particular, any dispute, resolution or legal litigation will be exclusively performed in Canadian courts, under the Canadian set of laws.
